⚖️ Terms of Service – The Preminent

Last Updated: October 6, 2025

Welcome to The Preminent ("we," "our," "us"). By accessing or using our website, services, consulting engagements, or expert network (collectively, "Services"), you agree to comply with and be bound by these Terms of Service ("Terms"). Please read them carefully before using our Services.

If you do not agree to these Terms, please refrain from using our Services.

1. About The Preminent

The Preminent is a global expert aggregation and consulting platform founded by Prem Kumar A S. We connect organizations — primarily small and mid-sized businesses (SMBs) — with verified experts, advisors, and consulting professionals in the domains of Technology, Cybersecurity, Strategy, and Growth ("4 Pillars").

Through our ecosystem, including Power of Knowing Forum, we transform knowledge and leadership experience into actionable business outcomes.

2. Scope of Services

The Preminent provides:

  • Business consulting and advisory services.
  • Fractional or project-based CXO leadership engagements (CIO, CTO, CISO, etc.).
  • Expert aggregation and talent sourcing for technology, strategy, and cybersecurity projects.
  • Public speaking, keynote, and knowledge-sharing engagements.
  • Digital resources, including case studies, publications, and podcasts.

All services are delivered on a consultative basis. We do not guarantee specific outcomes but commit to best-practice approaches, professional integrity, and confidentiality.

3. Use of the Platform

You agree to use our Services:

  • Only for lawful purposes;
  • Without infringing on the rights of others;
  • Without distributing harmful, misleading, or unlawful content;
  • Without misrepresenting your identity or affiliation.

Any misuse of our Services or attempt to damage the platform or brand reputation will result in immediate suspension or termination of access.

4. Client Engagements

Engagements with clients (organizations or individuals) are governed by specific contracts or statements of work (SOWs) that outline:

  • Scope and objectives;
  • Duration and milestones;
  • Fees and payment schedules;
  • Confidentiality clauses;
  • Termination and dispute resolution terms.

These engagement documents will supersede the general provisions here where applicable.

5. Expert and Partner Network

Experts, advisors, and consultants associated with The Preminent operate under independent professional agreements. They are responsible for the accuracy and quality of their contributions and must adhere to:

  • Ethical conduct;
  • Data privacy regulations;
  • Non-disclosure and client confidentiality;
  • Compliance with local and international laws.

The Preminent serves as a facilitator and aggregator, not an employer or legal representative of third-party experts.

6. Intellectual Property

All materials, content, podcasts, frameworks, publications, and visuals available under The Preminent brand — including Power of Knowing Forum — are protected under copyright and intellectual property laws.

You may not reproduce, redistribute, or commercialize any materials without explicit written permission from The Preminent.

7. Confidentiality

Both parties (The Preminent and Client) agree to maintain the confidentiality of all shared information, business data, and deliverables during and after the engagement period.

Exceptions apply only when disclosure is required by law or agreed upon in writing.

8. Data Protection & Privacy

We adhere to applicable global privacy standards, including GDPR and the India Digital Personal Data Protection Act (DPDP 2023).

Personal and business data collected through our website, booking platforms, or consulting engagements will be used solely for delivering Services and maintaining client relationships.

9. Payments & Fees

All fees are payable as per the agreed contract or engagement proposal. Late payments may incur interest or suspension of Services.

Refunds are considered only in exceptional circumstances and at the sole discretion of The Preminent.

10. Disclaimer of Liability

The Preminent provides Services on a best-effort, advisory basis. We make no express or implied warranties regarding:

  • Specific financial or operational outcomes;
  • Third-party products or integrations;
  • Continuity or availability of Services.

We shall not be liable for indirect, incidental, or consequential losses arising from the use of our Services.

11. Termination

Either party may terminate an engagement by providing written notice as outlined in the respective contract.

Upon termination, all dues for services rendered shall become immediately payable.

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

13. Changes to These Terms

We may update these Terms periodically to reflect operational, legal, or regulatory changes.

The updated Terms will be published on our website, and continued use of our Services constitutes acceptance of such changes.
